NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING THE SWEEPSTAKES.

GENERAL

The WARNERT RACING Give Away (“Sweepstakes”) is a sweepstakes in which eligible entrants will register for a chance to win a prize to be awarded in this Sweepstakes as described below. The winner(s) will be chosen, and prize(s) awarded in one or more drawings on the date(s) indicated below. The foregoing is a general description of this Sweepstakes which are governed in its entirety by these official rules (“Official Rules”). This Sweepstakes is sponsored by WARNERT RACING, Inc. (“Sponsor”). By participating in the Sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the sweepstakes, as determined by Sponsor and its agents, are final in all respects. Sweepstakes are subject to all federal, state, and local laws and regulations and are void where prohibited by law.

ELIGIBILITY

Sweepstakes are open to legal residents of the United States of America who have a valid United States mailing address, have reached the age of majority in their state of residence and who have a valid e-mail account and telephone number prior to the beginning of the Entry Period as defined below (“Entrant”). Sponsor has the right to verify the eligibility of each Entrant. Members of the WARNERT RACING and their immediate family members (spouse, parent, child, sibling, or spouse of each) or those living in the same household of a member are not eligible. Employees of manufacturers donating Sweepstakes prizes or employees of Vendors participating in the Hay Days Vendor Showcase are also not eligible. The sweepstakes is void outside of the United States of America and where otherwise prohibited. DO NOT ENTER IF YOU DO NOT MEET THE ELIGIBILITY REQUIREMENTS OR DO NOT AGREE TO THESE OFFICIAL RULES.

ENTRY PERIOD

The Sweepstakes entry period begins with the posting of the registration form on the Warnert Racing Website and ends at 9 PM Central Time on the day preceding the final drawing (the “Entry Period”). All entries must be received during the Entry Period. Sponsor reserves the right to extend or shorten the Entry Period at its sole discretion.

HOW TO ENTER

To enter this Sweepstakes, during the Entry Period, you must complete the electronic entry form in its entirety found at www.warnertracing.com. All fields marked as “required” on the form must be completed to be considered valid. Incomplete entry forms will not be accepted.

Entries shall be limited to one (1) per person. Excess entries may be cause for disqualification. Each Entrant is eligible to win only one prize. All entries become the property of Warnert Racing. All Entrants and entries are subject to verification prior to the awarding of a prize.

WINNER SELECTION

Eligible entries received during the Entry Period will be accumulated into a database and winners will be selected at random according to the schedule below (“Winning Entry”). A Winning Entry will be selected on the specified Drawing Date(s). Once selected as a Winning Entry, the Entrant is removed from the database and no longer eligible for future drawings in this Sweepstakes, if any. Winners will be contacted within three (3) business days of selection using information provided on the entry form. Each Entrant is responsible for monitoring his/her e-mail account and telephone number for prize notification and receipt or other communications related to the sweepstakes. Potential winners may be required to sign an affidavit of eligibility or other document to affirm eligibility. If a potential winning Entrant cannot be reached by the Sweepstakes Administrator (or Sponsor) within twenty (20) days of winner selection using the contact information provided at the time of entry, or if the prize is returned as undeliverable for any reason, that potential prize winner shall forfeit the prize and an alternate winner will be selected using the same criteria.

PRIZES AND ODDS OF WINNING Subject to the terms and conditions of these Official Rules, Warnert Racing will select each Winning Entry 10 days after the entry period concludes. The odds of winning a specific prize is directly dependent on the number of eligible entries received during the Entry Period, the date we receive your Entry, and the order in which each Winning Entry is selected.

EXCEPT WHERE PROHIBITED BY LAW, THE WINNER IS SOLELY RESPONSIBLE FOR ANY DELIVERY COSTS, TAXES, TITLE FEES, AND/OR LICENSE FEES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE.

Prizes will be distributed through a dealer designated by the equipment manufacturer. Taxes, title fees, registration and license fees vary by state and by intended use.

Incidental expenses and all other costs and expenses which are not specifically listed as part of any prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner.

Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form as a condition to receipt of the prize. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified. Prizes may not be awarded if an insufficient number of eligible entries are received The ARV of all 3 prizes is: $817.93.

USE OF DATA COLLECTED

By entering the sweepstakes, each Entrant acknowledges that Sponsor, Sponsor partners or agents may use the information for market research and may choose to send future advertising or marketing messages to the contact information provided. By entering this sweepstakes, you consent to Sponsor sharing the information provided with our Sponsor partners. Entrants have the right to opt out of any advertising or marketing promotions directly sourced by the Sponsor at any time by contacting us directly at Warnert Racing 1203 33rd St S, St Cloud, MN 56301, or by sending an email to twarnert@warnert.com

ADDITIONAL LIMITATIONS

Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor and its respective affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this sweepstakes is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the sweepstakes cannot be conducted as planned or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void, remove or disqualify suspect entries at issue or entries it deems non-compliant with these Official Rules. Sponsor and its respective affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, broadband provider, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise or any other malfunction, failure or error of any third party outside of Sponsor’s reasonable control.

INDEMNIFICATION AND LIMITATION OF LIABILITY

BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO INDEMNIFY, DEFEND, RELEASE AND HOLD HARMLESS SPONSOR, SPONSOR PARTNER AND THEIR AFFILIATE AND SUBSIDIARY COMPANIES, ANY ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES OR SPONSOR’S USE OF SUCH ENTRY, INCLUDING, BUT NOT LIMITED TO CLAIMS FOR TRADEMARK INFRINGEMENT, COPYRIGHT INFRINGEMENT, DEFAMATION OR VIOLATION OF ANY PRIVACY OR PUBLICITY RIGHT AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.

Entrants agree that this sweepstakes shall be governed by the laws of the State of Minnesota, and by entering, all entrants agree that any claims or disputes arising from or related to this sweepstakes shall be resolved in Minnesota.

PUBLICITY

By participating, each entrant grants Sponsor permission to use his/her name, likeness, or comments for publicity purposes without payment of additional consideration, except where prohibited by law. Winners names and city/state of residence may be posted on the Sponsor and/or Sponsor partners’ websites, Facebook pages, or made public through some other means.
